Former Philippine National Police chief and now Senator Ronald “Bato” dela Rosa recently asked the Philippine Supreme Court to stop any possible implementation of an International Criminal Court (ICC) arrest warrant against him, but the court did not grant his request for a temporary restraining order (TRO). A TRO is a short-term legal measure that can pause an action or decision while the court studies a case. Based on preliminary reports, the petition was linked to the ICC’s ongoing investigation into alleged crimes committed during the previous administration’s anti-drug campaign. The denial of the TRO means there is currently no special court order shielding him from potential ICC-related enforcement, at least for now. However, this does not by itself decide the full merits of his petition, which the court may still review.

The issue matters because the ICC investigation focuses on killings and alleged human rights violations connected to the “war on drugs” under former President Rodrigo Duterte. Dela Rosa was the national police chief at the height of that campaign and later became a senator, placing him at the center of both law enforcement and political discussions. According to initial data from rights monitors and official sources, thousands of people were confirmed unresponsive by authorities in anti-drug operations, though exact figures and circumstances remain disputed. The ICC seeks to determine whether some of these acts fall under its jurisdiction as possible crimes against humanity. Philippine authorities, meanwhile, maintain that police operations were largely lawful and targeted suspected criminals.

The Philippine government withdrew from the ICC in 2019, and this withdrawal has become a key legal point in the ongoing debate. Officials argue that the ICC no longer has authority over the country, especially for acts after the withdrawal took effect. The ICC, however, has stated in public documents that it can still examine alleged crimes that occurred while the Philippines was a member state. Based on available court filings, Dela Rosa’s petition to the Supreme Court was partly aimed at clarifying how these international proceedings might affect him personally. The Supreme Court’s refusal to issue a TRO does not resolve the broader question of the ICC’s reach, but it leaves existing legal uncertainties in place.
